Amber & Ash — Terms of Service

Publisher: Bonnie Bluewater, publisher of Amber & Ash (the “Publication,” “we,” “us,” or “our”)

These Publisher Terms of Service (“Terms”) govern your access to and use of Amber & Ash, including all free and paid content. By subscribing to or reading the Publication, you (“you,” “Reader,” or “Subscriber”) agree to these Terms.

These Terms supplement, and do not replace, Substack’s Terms of Use and Privacy Policy, which also apply to your use of the platform. Where these Terms address something Substack’s terms do not, these Terms apply to your relationship with the Publisher.

The Publisher operates under the pen name “Bonnie Bluewater.” The Publisher’s legal identity is on file with Substack, Inc. and its payment processor (Stripe) and can be identified where required by law.

1. Subscriptions, Billing, and Pricing

Some content is offered free; other content requires a paid subscription. Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) and renew automatically until cancelled.

Billing and payments are handled by Substack and its payment processor. You authorize recurring charges to your payment method until you cancel. You may cancel at any time through your Substack account; cancellation stops future renewals and your access continues until the end of the current paid period.

The Publisher sets and may change subscription prices at its discretion. No price change will apply retroactively to a period you have already paid for.

2. Refunds and Cancellation

The Publisher is not obligated to provide refunds for any subscription fees already paid. However, the Publisher may, at its sole discretion, issue full or partial refunds on a case-by-case basis. Requesting a refund does not entitle you to one. Cancelling a subscription ends future billing but does not automatically trigger a refund for the current period.

3. Intellectual Property and Permitted Use

All content published in Amber & Ash — including stories, text, titles, characters, artwork, images, and the Amber & Ash name and branding — is the original work of the Publisher and is protected by copyright and other intellectual property laws. The Publisher retains all rights.

Your subscription grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and read the content for your own private, non-commercial enjoyment. You may not, without the Publisher’s prior written permission:

Copy, reproduce, republish, post, or distribute the content, in whole or in part;

Share paid content with non-subscribers or resell or sublicense access;

Create derivative works, adaptations, or translations;

Use the content to train, fine-tune, or develop any artificial intelligence or machine-learning system; or

Scrape, crawl, or harvest the content by any automated means.

Brief quotation for review or commentary, with attribution, is permitted under applicable fair-use principles.

4. Fiction Disclaimer

Amber & Ash is a work of fiction. Names, characters, businesses, places, events, and incidents are either products of the author’s imagination or used in a fictitious manner. Any resemblance to actual persons, living or dead, or to actual events, is entirely coincidental. Nothing in the Publication should be read as a statement of fact about any real person or organization.

5. Mature Content and Age Requirement

Content in Amber & Ash is intended for adult readers 18 years of age or older. The nature and intensity of content varies from story to story and may include mature themes, strong language, dark subject matter, or explicit content. Individual posts may carry their own content notes, but the absence of a note is not a guarantee. By subscribing, you confirm you are at least 18 and consent to receiving content of this nature.

6. No Professional Advice; Entertainment Only

The Publication is provided for entertainment and creative purposes only. It does not constitute professional, psychological, medical, legal, financial, or other advice, and should not be relied upon as such.

7. Disclaimer of Warranties and Limitation of Liability

The Publication is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty that content will be uninterrupted, error-free, or available at any particular time.

To the fullest extent permitted by law, the Publisher will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Publication. In all cases, the Publisher’s total liability to you is limited to the amount you actually paid to the Publication in the twelve (12) months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Publication will be subject to the exclusive jurisdiction of the state and federal courts located in Illinois.

9. Changes to These Terms

The Publisher may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Your continued subscription or reading after changes are posted constitutes acceptance of the revised Terms.
